The arraignment is being held today in 8th District Court for a Duchesne County man being held in Duchesne County Jail on multiple charges, including 1st Degree Felony Aggravated Sexual Abuse of a Child, for alleged events that took place in August. 44-year-old Scott Mitchell Horvath was arrested on August 10th for the offenses of Aggravated Sexual Abuse of a Child, Aggravated Assault Producing Loss of Consciousness, Obstruction of Justice, and Domestic Violence in the Presence of a Child. According to the Affidavit of Probable Cause, law enforcement received a report of child sex abuse on August 9th. Law enforcement responded and during their investigation learned of the Domestic Violence incident that occurred just days before during which the adult female victim was strangled to the point of nearly losing consciousness in the presence of a minor. The victim still had marks on her neck from the incident. Law enforcement responded to Horvath’s place of employment to place him under arrest but he had left after telling his employer that he had an emergency and needed to leave. Officers arrived at his home around 10pm on August 9th but the lights were off and no one answered the door. Having the key from Horvath’s cohabitant, officers entered the home and found that he was locked inside a bedroom. Horvath’s response to police was that he had a gun and would use it on law enforcement if they entered the room. A trained hostage negotiator was brought in and at 4am Horvath finally surrendered and was placed in custody without further incident. Today’s court appearance will also include charges of felony Violation of Pretrial Protective Order which Horvath obtained while in custody of the Duchesne County Jail. Court documents state that correspondence took place between Horvath and the minor victim’s mother using home wave, Paytel, and text messages even though both had been advised by law enforcement of the Protective Order preventing any communication.
