The Ute Business Committee has approved a “Stay At Home And Curfew Order” for the Uintah and Ouray Reservation, effective May 5th and to continue until withdrawn by a formal Business Committee Resolution. Resolution No. 20-167 outlines that curfew hours are now 10pm to 5am. The Ute Business Committee shares that: “…immediate and drastic measures are necessary to mitigate the immediate threat of widespread, severe damage resulting from Covid-19. Based on the continued danger to our community, the Ute Indian Tribe Business Committee finds it in the interests of all tribal members and residents of our reservation to issue this Stay at Home and Curfew Order. The intent is to: Minimize contact between residents. Minimize the public’s exposure to contaminated surfaces. Maximize the number of people isolating in place. Reduce the number of people congregating in workplaces at one time. Reduce the proximity of people in the workplace. [And] enable the services necessary to protect public health and safety. Anyone found to be in violation of the directives set forth in this Order shall be assessed a civil fine in the amount of $500 per violation. We thank you for your understanding and cooperation as we navigate these unprecedented times. Stay safe.” As of Wednesday evening, the TriCounty Health Situational Report showed that there has been 6 confirmed cases of COVID-19 in Uintah County, 8 in Duchesne County, and 0 in both Daggett County and the Ute Indian Tribe.

STAY AT HOME AND CURFEW ORDER
The Ute Tribal Business Committee finds it in the interests of the health and safety of tribal members and residents of the Uintah and Ouray Reservation to issue the following Stay At Home and Curfew Order. The intent of this Order is to minimize contact between members and to the greatest extent possible minimize the exposure of the public to contaminated surfaces, maximize the number of people isolating in place, reduce the number of people congregating in workplaces at one time, reduce the proximity of people in the workplace, and enable the services necessary to protect public health and safety. This Order shall become effective at 12:00 A.M. on Tuesday, May 5, 2020 and will continue to be in effect until withdrawn by Business Committee Resolution.
All individuals currently living within the Uintah and Ouray Reservation are ordered to stay at home whenever possible and may leave their residences only to perform Essential Activities as defined in Section C below.
When individuals leave their residences, they must take all reasonable steps to wear a protective face mask.
Individuals may leave their residence only to perform the following Essential Activities:
Care for elders, minors, dependents, people with disabilities or other vulnerable people.
To purchase or obtain food, pet supplies, and essential household products for themselves, a household member, a family member, an elder, person with disabilities, or other persons in need of immediate assistance.
To obtain medical supplies or medication or to visit a health care professional for yourself, a family member, a household member, an elder, person with disabilities, any other person in need of immediate assistance, or a pet.
To care for a family member or pet in another household.
To engage in banking or other financial transactions or services.
To do to work in an essential or critical business activity or service as determined by their employer or a tribal governmental authority.
To engage in outdoor activities like walking, running, fishing, hunting, golf, or walking a dog, as long as they maintain a safe social distance from others.
To provide for the funeral arrangements of a family or household member.
Travel required by law enforcement or court order or as necessary for participation in a legal proceeding.
Going to or from educational facilities to support distance learning or to get school-provided meals or related educational services.
To get supplies to work from home.
To perform other necessary household functions to maintain cleanliness of the home and to ensure the health and safety of citizens and their families, including for purposes of trash disposal and using laundry services.
To engage in other essential activities as authorized in writing by the Business Committee.
All public and private gatherings of any number of people occurring outside a residence are prohibited except for the Essential Activities expressly permitted in this Stay at Home and Curfew Order. Nothing in this Stay at Home and Curfew Order prohibits the gathering of members living in the same residence.
All gatherings of more than ten people are prohibited.
All visitors on the Uintah and Ouray Reservation are directed to return home. For purposes of this Order, a visitor is a person who is not a tribal citizen, is not a spouse or minor child of a tribal citizen, does not maintain his or her permanent home on the Reservation, or who is not an employee of the Tribe or federal government.
No visitors will be allowed to come onto the Reservation, other than to pass through on a county or state roadway, except for the following Essential Services:
To provide medical or home care.
To provide emergency services.
To provide and allow for the continuation of essential and critical government services as determined by the Business Committee.
To provide necessary deliveries of water.
To provide deliveries of groceries, food, medicine, and other essential goods or services.
To provide deliveries of propane and other fuel for personal and tribal use.
To provide for essential household and building maintenance, safety and sanitation.
To provide for essential vehicle or equipment maintenance.
To initiate or participate in legal proceedings in the Ute Indian Tribal Court.
For public and private transportation providers providing transportation services necessary for purposes expressly authorized in this Order.
For the delivery of mail by the postal service and other shipping services.
To provide professional services, such as legal or accounting services.
To attend a wake or funeral of an immediate family member.
To provide any additional Essential Services to tribal citizens and residences on the Reservation as determined by the Business Committee.
All wakes and funeral shall adhere to the following guidelines:
Wakes and funerals shall limit the number of people in attendance to ten. This does not include funeral home staff, the clergy/officiants, or cemetery staff.
Attendees must practice social distancing – be at least 6 feet apart at all times.
Consider inviting friends and relatives to come separately. In the event of multiple wake nights, ask that friends and relatives rotate nights. Ask friends to attend during one time period and relatives during another time period.
Appoint relatives to focus on nothing but cleaning and wiping down door handles and frequently-touched surfaces.
Families must advise people if they have a fever of 100.4 degrees or any other symptoms to not attend.
Families may encourage people to be part of the caravan to the gravesite.
Consider livestreaming the wake and funeral as an alternative to in-person attendance.
Families may have a memorial at a later date.
All tribal contractors and vendors performing Essential Services must be willing to submit to a screening process.
Individuals who exhibit symptoms must isolate themselves for at least 14 days so as not to infect others.
There is hereby established a 10:00 P.M. to 5:00 A.M. curfew across the Uintah and Ouray Reservation, applicable to all individuals, seven days a week. All individuals shall be at home during curfew hours except in the event of an emergency. This curfew does not apply to Essential Employees reporting to or from duty, with official identification and/or a letter of designation from their Essential Business employer.
Anyone found to be in violation of the directives set forth in this Order shall be assessed a civil fine in the amount of $500 per violation. The Tribe’s Energy and Minerals Compliance Officers, Fish and Game law enforcement, and other law enforcement officers of the Tribe and of the Bureau of Indian Affairs shall enforce the provisions of this Order and shall investigate and gather information that may indicate that an act prohibited by this Order has occurred. The Tribal Court Prosecutor shall initiate a civil action in the Tribal Court to assess fines as provided herein.
